By accessing the Site, utilizing our services, or purchasing products from us, you agree to be legally bound by the following Terms of Service (the "Terms"). Please read these Terms carefully before placing an order. If you do not agree to all of these Terms, you are not authorized to use this Site or purchase any products.
1. General Framework
These Terms govern all commercial transactions, website interactions, and service utilization between you (the "Customer") and OMY Cellar. We reserve the absolute right to amend, update, or replace any part of these Terms at our sole discretion without prior notice. Any changes will be posted directly to this page with an updated revision date. Your continued use of the Site following updates constitutes explicit acceptance of those modifications.
2. Statutory Age Requirement

  • Legal Declaration: Under Hong Kong law, intoxicating liquor must not be sold or supplied to a minor in the course of business. By placing an order on this Site, you solemnly declare and confirm that you are at least 18 years of age (or the legal drinking age in your primary country/region of residence).
  • Verification at Delivery: OMY Cellar operates strict age-verification protocols. We reserve the absolute right to mandate that valid, government-issued photo identification be presented by the recipient at the time of delivery. If the recipient is unable to prove they are of legal drinking age, delivery will be denied, the items will be returned to our warehouse, and any secondary delivery attempts will incur standard administrative charges.

3. Product Availability, Pricing, and Website Errors

  • Availability Disclaimer: All product listings on our Site are subject to stock availability. Due to real-time market dynamics, inventory synchronization gaps, or sudden supplier discontinuations, an item may become unavailable after an order has been submitted. In such circumstances, OMY Cellar will contact you to offer an equivalent substitute or process a full refund.
  • Pricing Modifications: OMY Cellar reserves the right to modify prices, vintage allocations, and promotional offers at any time without prior liability or notice.
  • Exemption from Technical Inaccuracies: Human errors, system glitches, or technical lag may result in inaccurate pricing or typographical descriptions showing on the Site. OMY Cellar is under no legal obligation to honor transactions arising from clear pricing or inventory discrepancies. In the event of an error, OMY Cellar reserves the right to unilaterally cancel the affected order prior to fulfillment, notify the customer, and issue a full refund.

4. Order Placement, Acceptance, and Payment Terms

  • Formation of Contract: The receipt of an electronic order confirmation does not signify OMY Cellar’s formal acceptance of your order. It serves merely as an acknowledgment of your purchase request. A legally binding sales contract is only formed when your order has been officially processed and dispatched from our warehouse. We reserve the absolute right to refuse, limit, or cancel any order at our sole business discretion.
  • Payment Settlement: Payment must be settled in full at the time of checkout. We accept authorized credit cards (Visa, Mastercard) and PayPal.
  • Fraud Prevention: We reserve the right to cancel or suspend transactions if our security gateways flags an order for suspected fraudulent activity, unauthorized identity usage, or illegal card usage.

5. Shipping, Delivery, and Passing of Risk

  • Territorial Coverage: Delivery services are strictly limited to specified physical addresses within Hong Kong.
  • Fulfillment Timeframes: We endeavor to fulfill and deliver orders within five (5) business days following order confirmation. However, delivery timeframes are non-binding estimates and may be subject to delays due to logistics disruptions, adverse weather conditions, or unforeseen events.
  • Delivery Fees:
    • Free Delivery: Applicable to all single orders with a net transaction value equal to or exceeding HKD $1,200.
    • Standard Fee: Orders falling below HKD $1,200 will be subject to a fixed shipping and handling fee of HKD $150.

6. Passing of Risk and On-Site Inspection

  • Mandatory Examination: Customers (or their authorized delivery recipients) are legally required to carefully inspect all structural packaging, quantities, and labels immediately upon delivery. Any physical damage, leakage, broken seals, or fulfillment discrepancies must be reported directly to the courier personnel on the spot and documented.
  • Passing of Liability: Once the delivery receipt is signed or the goods are accepted without immediate written objection, all risk of loss, damage, or product deterioration passes entirely to the customer. OMY Cellar will entertain no subsequent claims for physical defects or external damage reported after delivery. Returns are governed strictly by the valuation and timing terms laid out in our Return & Refund Policy.

7. Corked or Inherent Defect Policy
Claims regarding naturally spoiled or "corked" wines are subject to a maximum bottle valuation threshold of HKD $800. Premium bottles priced at or above HKD $800 are sold strictly on an "as-is" basis due to their rare and collectible nature. Please review our separate Return & Refund Policy for the precise technical criteria required to file a valid claim.
8. Intellectual Property Rights
All proprietary content displayed on this Site—including but not limited to brand logos, custom imagery, graphics, text layout, website code, and product descriptions—is the exclusive intellectual property of OMY Cellar and is protected under prevailing trademark, copyright, and intellectual property laws. Unauthorized reproduction, distribution, modification, or commercial exploitation of any site content without explicit written authorization from OMY Cellar is strictly prohibited.
9. Limitation of Liability and Force Majeure

  • Disclaimer of Damages: To the maximum extent permitted by the laws of Hong Kong, OMY Cellar, its directors, and employees shall not be held liable for any direct, indirect, incidental, punitive, or consequential damages resulting from your use of the website, software errors, or the consumption of products purchased from us.
  • Force Majeure: OMY Cellar is absolved of all operational liabilities and delays caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government blackouts, severe typhoons/rainstorms, strikes, civil unrest, or global supply chain breakdowns.

10. Data Privacy and Governance
Your submission of personal data through the storefront is securely processed and governed strictly in accordance with our Privacy Policy, which complies with the Personal Data (Privacy) Ordinance (PDPO) of Hong Kong.
11. Governing Law and Dispute Jurisdiction
These Terms, along with all associated commercial operations and legal relations, shall be governed by, interpreted, and construed exclusively in accordance with the laws of the Hong Kong Special Administrative Region (HKSAR). Any legal disputes, claims, or litigation arising out of these terms shall be submitted to the exclusive jurisdiction of the competent courts of Hong Kong.
OMY Cellar Price Promise (Addendum)
At OMY Cellar, we are committed to providing competitive and fair pricing across our premium wine portfolios in Hong Kong. We want you to shop with complete confidence regarding the value of your purchase.
Operational Mechanics:
If you identify an identical wine offered at a lower retail price by another licensed wine retailer operating in Hong Kong, please notify us prior to your purchase or within 7 days of transaction completion. Upon verification and approval of eligibility, OMY Cellar will reward you with a complimentary bottle of wine (selected solely at the discretion of OMY Cellar) with your subsequent purchase.
Strict Eligibility Guidelines:

  1. Identical Product Specification: The competing item must be completely identical in brand, specific vintage, producer, classification, and bottle volume.
  2. Authorized Retail Channels Only: The lower price must originate from a validly licensed, commercial wine retailer physically or digitally operating within Hong Kong.
  3. Exclusion of Liquidations and Promotions: This promise strictly excludes clearance sales, bankruptcy liquidations, short-term promotional campaigns, membership-only discounts, flash sales, or parallel imported goods.
  4. Verification Requirements: The customer must supply indisputable evidence of the lower price, consisting of either a live, verifiable website link or an authenticated in-store photograph showing current stock availability at that price.
  5. Volume Limitation: A maximum of one (1) complimentary reward bottle will be issued per approved claim, regardless of the quantity of identical items purchased.
  6. Final Determination: OMY Cellar retains the absolute legal right to determine the validity of any claim, evaluate competitor legitimacy, and select the specific bottle allocated as the complimentary reward.
